TERMS AND CONDITIONS OF USE
WHO WE ARE
Quisito, hereafter referred to as "Quisito" or "platform", is a software for generating online survey questionnaires using artificial intelligence. Quisito acts as a research assistant, with which the user creates questionnaires, launches surveys and generates reports, all automated. Quisito's web address is quisito.ai.
HOW TO OPERATE QUISITO.AI
To access Quisito you need to create an account on quisito.ai.
Registration and access to this platform are open to all individuals over the age of 21, legal entities legally registered in accordance with Romanian or any other country's legislation wishing to conduct a survey. However, we reserve the right to refuse certain persons access to our platform. We reserve the right to delete accounts that we consider likely to defraud the system in any way.
ACCOUNT CREATION
You need a valid email address to register on the platform.
Participation in this platform involves filling in an online form containing various personal identity information for individual users (first and last name, email address). Fields marked with * are mandatory.
For legal entities, data related to company name, registered office, data related to registration number and tax code, etc. will be requested - data needed in the invoicing process.
False data is not allowed. Quisito reserves the right to request at any time additional information from its users regarding their identity and/or existence. If it is found that false data has been provided by a user, he/she will lose access to the account, questionnaires and reports generated by the platform, and they will be automatically deleted.
Quisito reserves the right to use the e-mail address communicated by users when registering on the platform for further communications, or for various other requests.
Quisito reserves the right to block a user's access to the platform after registration, if it finds that the user has attempted to defraud the rules of operation, has provided false data, has not complied with the platform's terms of use or other types of fraud identified during the course of the registration.
In the event of deletion of the user profile determined by the above conditions, the registration of a new profile with the same or different data as the original data is prohibited. If such a User registration is identified by Quisito, the profile will be automatically deleted without any prior notice.
Registration in the platform does not oblige the User to generate a minimum number of questionnaires
Users may at any time request anonymization or deletion of their account.
This can be done by sending an e-mail with the subject "I wish to deactivate / delete my account" to hello@quisito.ai. Upon completion of the procedure, the user will receive an e-mail confirming the deletion or deactivation of his/her account.
Creating an account is mandatory, and having an account will allow you to have access at any time to the questionnaires you have created, to the reports generated from the polls using your questionnaires.
By creating an account, you accept these terms of use of Quisito.
CREATING OPINION POLLS. GENERATING QUESTIONNAIRES
By accessing the Quisito platform you can create your own questionnaire that you can use to launch your opinion poll.
Depending on the problem you have presented, the virtual assistant will generate an initial questionnaire (a series of questions with answer options).
You can edit the questionnaire by chatting with the virtual assistant by sending messages in the chat platform or voice messages and thus you will customize your survey according to your requirements. By editing we mean adding or deleting new questions or answer options, modifying existing questions, requesting clarifications or translations.
We inform you that the questionnaires that you create with Quisito must not contain questions that are obscene, discriminatory, offensive, aggressive, threatening, obscene or do not comply with the rules of conduct and morality. Questions that ask respondents for personal data or any data that may lead to the identification of the respondent in any way are also prohibited, i.e. questions focused on discrimination criteria, sexual orientation, etc.
To the extent that the platform identifies in the final questionnaire created questions that are prohibited under these terms and conditions, it will automatically remove such questions from the questionnaire. If any attempt is made to modify the questionnaire by reintroducing such questions, Quisito may decide to suspend the user account.
In case, due to a technical error, the final questionnaire generated by the platform will contain questions from the category of those not accepted, the final responsibility for their use lies with the platform User and not Quisito, the User bearing full responsibility for any damage, complaint or injury suffered by respondents or other third party, the damage to be borne exclusively by the User.
The questionnaire can be used by the User for his/her own respondents or sent to respondents from Quisito's partner panels, and after running it Quisito will generate the report with the results of the opinion poll. The report can be generated as csv graphs or tables.
TYPES OF PRODUCTS/SERVICES AND PRICES
Generating questionnaires through Quisito is free of charge, including editing them until the user reaches the final agreed form.
Launching the survey using the questionnaire generated and modified through Quisito is a paid service. Depending on the country or target audience of the survey and the desired sample (number of responses, age or gender segments, other demographic characteristics) the User will receive a cost for the survey. To launch the survey, the cost must be accepted and payment must be made online through the payment system provided by Quisito.
Once the cost is accepted and the payment is made, the project cannot be canceled and there is no possibility to return the payment, as the questionnaire and its launch is a product and service customized at the User's request.
MAKING PAYMENT FOR THE SERVICE
Once you have decided on the specific conditions for running the survey through Quisito, you will make your payment through our payment processor Stripe (https://stripe.com/).
The payment for purchases through Quisito will be made in the invoiced currency (Euro, USD, etc) and the price and payment method are specified each time you finalize the purchase of a survey.
For a proper verification of all details of the products ordered, when finalizing your purchase, you are required to check the products placed in the shopping cart and their price.
The price of the products/services will specify VAT and additional taxes if applicable.
Payment for products will only be made online using the stripe.com online payment service, payment will be sent directly for processing.
By entering the card data, the User confirms that he/she has been informed and accepts the terms and conditions of use of the Stripe service and agrees that the data may be used for future transactions.
By accepting Stripe's terms and conditions, you consent to the processing of your personal data.
When you select and purchase the survey, the value of the survey will be blocked in your account for payment purposes. Your card will be debited in accordance with banking regulations. In any case, the security of online card payment transactions is guaranteed by the terms and conditions of use of the Stripe processor https://stripe.com/en-ro/legal/consumer, https://stripe.com/en-ro/legal/ssa, https://stripe.com/en-ro/privacy. At no time is Quisito in possession of the full number of the card you have entered. The card data through which you make the payment will not be accessed or retained by Quisito, but only by Stripe and the entities mentioned by Stripe. The entity authorized to provide services for the storage of card identification data is the one operating through the Stripe platform whose detailed information can be found here https://stripe.com/en-ro/legal/consumer/contracting-entity.
In certain situations, for the security of the transaction, at the time of purchase of the questionnaire, you will be asked to authorize the payment by re-entering your password or by using your digital signature, if the mobile terminal allows this facility. For payment security reasons, you are strongly advised to log out of the website and not to set automatic authentication on mobile devices. Disclosure of your password
is prohibited and must be kept strictly confidential. The user can make payment using data from multiple payment cards only for different orders, not for a single order.
OWNERSHIP RIGHTS. PROHIBITION TO RE-USE THE QUESTIONNAIRE FOR COMMERCIAL PURPOSES
The generation of the questionnaire by the User gives him/her the right to use it in order to carry out his/her own opinion poll and guarantees its use whenever the User needs it.
The questionnaires generated by Quisito are intended solely for the use of the user who has purchased them for his/her own interest and not as a means of resale to third parties.
The questionnaire concept is based on Quisito's own know-how. Unauthorized redistribution may damage Quisito's products and image.
Accordingly, it is prohibited to sell, buy or receive Quisito products/services offered for the purpose of resale, online or offline. Such actions may entail civil and, where applicable, criminal liability of the authors for infringement of our trademark rights. Counterfeiting or unauthorized use of the Quisito name may also result in civil or criminal liability.
INFORMATION PUBLISHED IN QUISITO
As far as possible, Quisito wants to ensure the accuracy and up-to-dateness of the information on this platform and reserves the right to make changes to the content at any time. Quisito disclaims any liability with regard to:
any damage resulting from the fraudulent penetration of a third party who has made a modification to the information made available to you in Quisito;
any direct or indirect damage, irrespective of its cause, origin, nature or consequences, caused due to any person's access to the platform or inability to access, use and/or reliance on any information directly or indirectly derived from it;
lack of access to Quisito or difficulty in using it, as well as the consequences resulting from lack of access or difficulty in using it for its intended purpose;
damage/lack of access due to force majeure;
actions of a user or third party for which we are not responsible;
technical problems occurring in the hardware, information technology system and telecommunications infrastructure used by the user;
any damages resulting from your or other users' actions that do not comply with applicable law or the provisions of these terms of use;
damages incurred by the user due to dangers on the Internet, resulting from circumstances not attributable to Quisito, in particular for system hacking, intrusion, theft of passwords of purchases by third parties, system infected with viruses or other malicious or harmful programs;
hypertext links may lead the user to sites other than this platform. Quisito makes no representations whatsoever about other sites, assumes no responsibility for the security, content, availability, and any other materials contained in other sites and disclaims any liability in cases where their content contravenes applicable laws and regulations.
Any creation of hypertext links to the home page of this Platform or any other Quisito page may only be made with the express prior written consent of Quisito.
RESTRICTIONS ON THE USE OF QUISITO
It is strictly forbidden to:
use Quisito in a way that disrupts its operation;
take any action that may interfere with the Quisito software;
sending or posting unsolicited commercial information within Quisito, carrying out IT activities or other activities aimed at inserting information not intended for the User, providing illegal content, i.e. violating the applicable law, the rules of social coexistence or the rights of third parties;
the use of Qusito for purposes that do not fall within a use for personal purposes, in particular for the development of other businesses. Violation of these restrictions entails the user's liability for full coverage of all damages created. It is not permitted in any way and you will be held liable for any misuse deliberately introducing computer viruses of hardware and software, as well as any other unauthorized computer programs or material that is malicious or technologically harmful.
any attempt to gain unauthorized access to Quisito, the server that hosts Quisito or any other server, computer or database associated with Quisito. You will be liable for any attack on this platform through any hacking attack. Please note that any such action may constitute a criminal offense under applicable regulations, and we will report any such violation to the appropriate authorities.
In any case of abuse or deviation from the above restrictions your right to use Quisito will cease/can be blocked with immediate effect.
RISKS ASSOCIATED WITH USING QUISITO
The use of Quisito and the services provided electronically is carried out via the Internet, which may entail certain risks normally associated with the use of Internet networks.
The risks associated with using the Internet include, among other things, the possibility of introducing software that could cause harm, such as "Viruses" (viruses) or other derivatives thereof. In connection with the above, to combat such threats, it is recommended that the user have up-to-date anti-virus software and other programs to protect devices against unauthorized access by third parties.
Another risk to protect against would be unauthorized access to equipment and data by third parties without the knowledge and against the will of the user/owner. In order to prevent such actions, it is recommended to keep the password allowing access to your user account strictly confidential.
MODIFICATION OF THE TERMS AND CONDITIONS OF THE QUISITO
Any changes to these terms and conditions will take effect on the date of publication on the platform. In case of disagreement with the new Terms and Conditions the User may terminate the contract by requesting deletion of the account. As a rule, the modification of the Terms and Conditions will be based on the need to modify IT systems, optimize processes and procedures as well as Quisito products, the creation of new functionalities, adaptation to new legislative requirements, suggestions received from Users, etc.
We reserve the right to remove any product or service from the platform at any time at
our discretion and to remove or modify any material or content on this website.
These Terms and Conditions of Use are supplemented by the provisions of the applicable law, the Distance Selling Terms and Conditions, the Personal Data Protection Policy and the Cookies Policy which can be found here [link].
APPLICABLE LAW
The legal relationships arising from the use of Quisito, including issues related to the validity, conclusion, execution and termination of service contracts or contracts for the purchase of Quisito products and services, as well as any legal relationships created when using the site, are subject to Romanian law, and disputes regarding any of these shall be subject to the jurisdiction of the courts or competent authorities in Romania. Quisito communications are made in writing, in Romanian or English, by e-mail, sms or by posting on the platform.

Any purchase of one of Quisito's products or services is made by placing an order using the platform which is equivalent to a distance selling channel and implies acceptance by the buyer of these Distance Selling Terms and Conditions. If you do not agree to these Distance Selling Terms and Conditions please DO NOT select one of our products in order to avoid placing an order. Placing an order by any means of Distance Selling has the value of a contract of sale concluded in these Distance Selling Terms and Conditions. The moment of the conclusion of the distance selling-purchase contract is the moment of Quisito's confirmation of acceptance (registration) of the order submitted by the consumer.
By registering your payment, Quisito accepts your order.
The information in these Distance Selling Terms and Conditions and any Terms or data contained in this platform does not constitute an offer to sell, but an invitation to an offer to buy. No contract will be entered into between you and Quisito for any product or service until Quisito receives proof of payment. These Distance Selling Terms and Conditions may be updated, modified or supplemented from time to time by Quisito. Consequently, whenever you place an order, we recommend that you return to this section and review the terms applicable at the time you place your order.
The Terms and Conditions of Distance Selling are supplemented by Quisito's Terms of Use and the provisions related to the Personal Data Protection Policy and Cookies Policy sections. Please read them.
The Distance Selling Terms and Conditions are supplemented by the provisions of the Romanian legislation in force. Romanian law shall govern any sale made through Quisito.

No waiver by us of any of the rights set forth in the Distance Selling Terms and Conditions and Platform Terms of Use will be effective unless Quisito expressly specifies that it is a waiver and notifies you in writing that it is waiving.
